Defendant’s Motion for Attorneys Fees
TENTATIVE RULING
The trial court has discretion in deciding whether to award attorneys fees and costs to a party prevailing in a civil harassment case. C.C.P. §527.6(s); Krug v. Maschmeier (2009) 172 Cal.App.4th 796, 802.
The court exercises its discretion to award attorneys fees and costs here, but has adjusted the amount of fees requested for the work it finds necessary in this case, and the hourly rate to that charged by attorneys in this area doing similar work. Fees therefore are awarded in the total amount of $750.00 (3 hours, $250/hour), and costs awarded in the amount of $525.00, for a total award of $1,275.00 in fees and costs against Petitioner DESIRAE FORD.
