RULING
For the reasons discussed in detail below, the court finds the final environmental impact report prepared for this residential development project complies with the requirements of the California Environmental Quality Act (Pub. Res. Code § 21000 et seq.) (CEQA) and the petition for writ of mandate is denied.
Introduction After a decades’ long effort to develop its 110—acre unimproved parcel property in unincorporated Marin County and adjacent to the Town of Tiburon, in October 2017 Real Party In Interest, The Martha Company (Martha) obtained approval from Respondent County of Marin to develop 43 minimum one-half acre, single-family lots on about 30 acres of its property with the rest of the parcel (about 75 acres or 68%) dedicated to the County as open space, (aka: “the Project”) (AR 207, 229, 3526-3528.)
