Based on the information provided, it appears to the Court that the Petition establishes the criteria set forth in Ins. Code § 10139.5 et seq. and that the proposed transfer is fair, reasonable, and in the Payee’s best interest. However, the Court notes that the Payee’s spouse did not sign the transfer agreement, and the Court is hesitant to approve the same without her signature thereon. Therefore, Petitioner’s counsel shall appear to present a revised transfer agreement that bears the signatures of both Payee and his spouse, or to otherwise advise the Court of the status of Petitioner’s efforts to obtain same.
