CV-22-002818 – BENNETT, PAMELA vs PACAFI INC – Plaintiff’s Motion for Discovery Sanctions and to Continue the Trial and Settlement Conference Dates – GRANTED, in part, DENIED, in part.
The Court finds that Defendant’s conduct herein constitutes misuse of the discovery process. (CCP §2023.030). The Court also finds that Defendant has twice failed/refused to comply with the Court’s orders to produce the requested discovery and to pay monetary sanctions without justification. Additionally, the Court in its previous order of 10/4/23 warned Defendant that further failure to comply with the Court’s orders could result in the imposition of more stringent sanctions up to and including terminating sanction. (Cornerstone Realty Advisors, LLC v. Summit Healthcare Reit, Inc., (2020), 56 Cal. App. 5th 771).
