28 Does Defendant admit that he was on the phone at the time of the accident? If yes, the motion to quash is granted. Under these circumstances, the Court finds that Defendant's right to privacy outweighs and likelihood that the discovery will lead to the admissibility of admissible evidence. On the other hand, if Defendant denies that he was on his cellphone at the time of the accident, the Court denies the motion the motion to quash, but orders that Plaintiff issue a revised subpoena requesting only information for the period of 15 minutes before the accident to 15 minutes afterwards.
