Motion for Terminating, Issue, and/or Evidentiary Sanctions
Having considered the moving, opposing, and reply papers, the Court rules as follows.
BACKGROUND
On August 29, 2018, Plaintiff Beverly A. Gramlich (“Plaintiff”) filed a complaint against Defendants Carlos Escobar (“Defendant Escobar”) and Brigido Espinoza Soriano (“Defendant Soriano”) (collectively “Defendants”). Plaintiff alleges general and motor vehicle negligence in the complaint for an automobile collision that occurred on September 6, 2016.
On January 2, 2019, the Court deemed this case to be related with case number BC719851.
On April 22, 2020, Plaintiff filed a motion for terminating, issue, and/or evidentiary sanctions against Defendants pursuant to California Code of Civil Procedure section 2023.030.
On April 24, 2020, the Court scheduled the hearing on Plaintiff’s motion for sanctions to be heard on September 4, 2020.
On June 3, 2020, the Court advanced the hearing on the motion to July 24, 2020.
