Defendants United Resources Information Inc. and Jasmine Park’s
motion for summary judgment is DENIED. Defendants’ alternative motion for summary adjudication is GRANTED as to Issues Nos. 3 and 4 and DENIED as to all other issues.



Background





On August 14, 2018, Plaintiff Ted Lin (“Plaintiff” or “Lin”) filed the instant employment discrimination/sexual harassment complaint against Defendants United Resources Information Inc. (“URI”), and Jasmine Park (“Park”) (collectively “Defendants”). The operative Second Amended Complaint (“SAC”) alleges five causes of action for: 1) hostile work environment/harassment on the basis of sex; 2) discrimination on the basis of race in violation of FEHA; 3) failure to prevent harassment and discrimination; 4) retaliation in violation of FEHA; and 5) constructive discharge in violation of public policy.
