Motion to Reclassify

The court considered the moving papers. No opposition was filed.

On September 13, 2017, plaintiff Luz M. Perez (“plaintiff”) filed a complaint against defendant Ricardo Antonio Barbosa (“defendant”) for motor vehicle negligence based on a November 11, 2015 collision.

Trial is set for March 13, 2019.

Defendant requests that the court reclassify this case as one of limited jurisdiction, pursuant to CCP § 403.040.

Defendant contends that plaintiff is responsible for causing the accident because she made an unsafe left turn directly across the path of defendant’s vehicle. Further, defendant cites to plaintiff’s deposition and contends that plaintiff has no physical injuries arising from this accident. Plaintiff alleges mental anguish arising from stress related to her research and prosecution of this matter. Plaintiff testified she has not sought treatment with any health providers and will not do so. Plaintiff’s discovery responses allege psychiatric treatment at
