BACKGROUND

This is a “lemon-law” action arising out of the purchase of a vehicle sold by Defendants. Plaintiff Richard Green (“Plaintiff”) brings this action against Defendant Ford Motor Company (“Defendant”) for (1) violation of Song-Beverly Consumer Warranty Act; (2) breach of implied warranty of merchantability; (3) negligence; and (4) strict liability.

REQUEST FOR JUDICIAL NOTICE

Plaintiff’s request for judicial notice is GRANTED.

DISCUSSION

A motion for judgment on the pleadings may be made on the same grounds as those supporting a general demurrer, i.e., that the complaint fails to state facts sufficient to constitute a legally cognizable claim. (Stoops v. Abbassi (2002) 100 Cal. App. 4th 644, 650.)

Plaintiff moves for judgment on the pleadings on Defendant’s
