On December 2, 2015, Plaintiff Karen Orange (“Plaintiff”) filed this action against Defendants Charlotte Jackson and The Jackson C.A. Living Trust (“Defendants”) for alleged damages arising out of a June 6, 2015 slip and fall. Plaintiff alleges causes of action for: 1) premises liability; and 2) general negligence. Plaintiff alleges that Defendants negligently maintained the premises as 30725 Cartier Drive, Rancho Palos Verdes, California 90275 so as to cause a dangerous and hazardous condition, hay on the floor, which caused Plaintiff to slip and fall. Plaintiff’s premises liability cause of action contains two counts: 1) Count One-Negligence; and 2) Count Two-Willful Failure to Warn. Defendants move to strike Count Two.
