April Grundfor (Plaintiff) brings this whistleblower action against her former employer California Department of State Hospitals-Atascadero State Hospital (Defendant) alleging that she was terminated from her employment as a clinical social worker because of her reports of inadequate protocols and refusal to alter records in connection with the murder of a patient by another patient. Plaintiff’s causes of action rely upon statutes intended to protect employees from retaliation for whistleblowing.

Defendant previously demurred to all causes of action in the first amended complaint; the Court sustained the demurrer with leave to amend. Plaintiff’s second amended complaint again alleges three whistleblower based causes of action and Defendant again demurs to each cause of action. Plaintiff opposes the motion.
