Motion: Plaintiff’s Motion for Order Granting Final Approval of Class Action Settlement
Tentative Ruling: To grant Plaintiff Vicente Ramos’s Motion for Final Approval of Class Action Settlement.
On October 4, 2018, the court preliminarily approved the terms of the settlement including the form of notice, provisions for payment of costs, attorneys’ fees, administrative expenses, and plaintiff’s enhancement award. The claims administrator mailed notice of the settlement to all 74 class members. Of the 74 notices mailed, 11 were returned as undeliverable and were sent to Experian for skip tracing. Updated addresses were not obtained for any of the 11 undeliverable pieces and Notices could not be re-mailed. No Notices were returned with forwarding address information. Thus, 63 individuals or 85.14% of the Settlement Class were successfully noticed by mail. No objections or requests to opt out were received by the administrator.
