Petitioner’s motion for attorney fees and costs is DENIED.
Petitioner Mary Silvers Vega is the successor trustee and a beneficiary of the Slivers Family 2001 Revocable Intervivos Trust. Her brother, James Silvers, is the only other beneficiary of the Trust. Petitioner brought this action to force her brother to sell his share of the family home to her. Petitioner contended she had the power to do so under the Trust and James objected. On the second day of trial, the parties agreed to settle the matter and put the agreement on the record. Petitioner agreed, among other things, to pay James $280,000 for his share of the home. The parties also agreed that Petitioner could bring a motion for attorney fees and costs, which James could oppose on whatever grounds the law allows. The fees were also to be capped at $25,000.
Petitioner now moves for the attorney fees of $24,557.50 and costs totaling $698. Petitioner contends these fees and costs are reasonable and were incurred by her as trustee
