HEARING ON MOTION TO STRIKE THE 1st Amended COMPLAINT

* TENTATIVE RULING: *
Defendants moved to strike the prayers for punitive damages and attorney fees from plaintiffs’ first amended complaint. In response, plaintiffs expressly offered to strike those very provisions, proffering a proposed second amended complaint accordingly, and a stipulation to its filing. Defendants’ counsel unaccountably refused the stipulation, apparently demanding some further assurances that went beyond the scope of their own motion and beyond what could have been obtained from the Court on that motion.
Defendants’ motion is accordingly denied, conditioned on plaintiffs filing the second amended complaint as proposed. Plaintiffs are given leave of court for that purpose. Defendants’ counsel are advised to stop playing games and wasting the Court’s time.
