petition for approval for transfer of structured settlement payment rights
BACKGROUND
On October 2, 2018, Petitioner Catalina Structured Funding, Inc. (“Petitioner”) filed the Petition for Approval for Transfer of Structured Settlement Payment Rights by and between Christopher Grace (“Transferor”) and Petitioner, pursuant to Insurance Code, §10134 et seq. Transferor entered into an agreement for the settlement of a wrongful death claim. (Pet., ¶6.)
The settlement agreed to by Transferor provides for a certain lump sum and periodic structured payments, including but not limited to: 96 monthly payments of $2,679.00 beginning August 10, 2026 through and including July 10, 2034 with a 6% annual increase each August. (Pet., ¶8, Ex. B.) Transferor has agreed to sell to Petitioner this lump sum and/or periodic structure payments as described in the purchase agreement for $150,000.00. (
