Defendants’ Demunrer is SUSTAINED as to Plaintiffs cause of action (COA) for Breach of Fiduciary Duty. Defendants’ Demurrer is OVERRULED as to Plaintiff’s First, Second, Fourth, Fifth, Sixth and Seventh Causes of Action, The Court vacates its order requiring appearances on December 23, 2020.
On December 16) 2020, Defendants’ counsel Amy Bomse appeared for oral argument. At that hearing, Defendants’ counsel represented that she communicated with Plaintiff Val Homstein about her request for oral argument and Plaintiff pointed out that Defendants’ counsel failed to comply with Marin County Local rules in making a timely request for oral argument.
