Plaintiff's counsel is correct that this court continued the hearing to allow Plaintiff to file a proof of service of Plaintiff's Motion for Summary Judgment on Defendants Pineda and Rodriguez, but then erroneously vacated the hearing date, although the proof of service was filed.
Therefore, the Court hereby corrects its Ruling on Submitted Matter dated July 22, 2020, as follows. Page 4 lines 5-8 are revised:
Plaintiff's Motion for Summary Judgment as to Defendants Pineda and Rodriguez is granted. The motion was timely served on defendants and defendants have not filed an opposition to the motion. The court finds that plaintiff has met its burden of persuasion that all elements of each cause of action can be established. See Aguilar v. Atlantic Richfield Co. (2001) 25 Cal.4th 826, 850.
