Background
Plaintiff David Alvarez (“Plaintiff”) filed this Lemon Law action on June 18, 2018 against Defendant Ford Motor Company (“Ford”). Plaintiff alleges that his 2014 Ford Focus suffered from defects which Ford has been unable and/or has refused to repair after a reasonable number of attempts.
Ford now moves to dismiss the instant action pursuant to Code of Civil Procedure section 581, subdivision (m) and section 583.150 on the ground that Plaintiff’s lawsuit is barred by a nationwide settlement in a class action lawsuit captioned Vargas v. Ford Motor Company, C.D. Cal. Case No. 2:12-cv-08388-AB-FFM (the “Vargas Action”). The motion is unopposed.
