Plaintiff Manatek Commercial Insurance Services Inc.’s motion for leave to file a Third Amended Complaint is DENIED.

On June 19, 2018, Plaintiff Manatek Commercial Insurance Services Inc. (“Plaintiff”) filed the instant suit against Defendants Rolinda Day (“Day’), R. Day Insurance Agency LLC (“Day Agency”) (collectively “Day Defendants”) for breach of contract and fraud. On February 22, 2019, Plaintiff filed the Second Amended Complaint (“SAC”), adding Farmers Insurance Company Inc., Farmers Insurance Exchange, Truck Insurance Exchange, Fire Insurance Exchange, Mid-Century Insurance Company (collectively “Farmers Defendants”). The SAC states five causes of action for 1) breach of contract; 2) conversion; 3) money had and received; 4) quiet title to money; and 5) accounting.

This dispute arises out a series of insurance broker contracts between Plaintiff and the Day Defendants. In July 2016, Plaintiff, as an independent insurance broker, entered into a contract with the Day Defendants
