[TENTATIVE] ORDER RE: DEFENDANTS’ MOTION TO QUASH PLAINTIFF’S SUBPOENAS FOR RECORDS

This action arises out of a June 17, 2017 incident wherein 13-year-old Plaintiff Nina Burch (“Nina”) fell head-first into an above-ground pool, resulting in permanent traumatic brain injury and spinal cord injury. Plaintiffs Lisa Burch, Nina’s Guardian Ad Litem, and Nina (collectively, “Plaintiffs”) filed this action on November 13, 2017 alleging Defendants Intex Crop., Intex Recreation Corp., and Intex Group (collectively, “Defendants”) sold a defective above-ground pool and pool ladder, which caused Nina’s injuries. Plaintiffs served deposition subpoenas for records on Dennis L. Webb and Stephen M. Feurch, two attorneys who apparently litigated cases for other plaintiffs against Defendants involving Defendants’ pool ladders. Defendants move to quash the subpoenas.
