Factual AND PROCEDURAL Background
The First Amended Complaint (“FAC”) in this action alleges that Plaintiff Eric Barton (“Barton”), a former NFL player, was a member of EBB Promotions, LLC (“EBB”), a Maryland LLC. (FAC ¶¶ 1, 2.) Barton was a client of defendants Rodney Rice III (“Rice”) and James and Colleen Dresselaers (the “Dresselaers”), both of whom ran sports management businesses. (FAC ¶¶ 3– 25.) Barton alleges that Rice, the Dresselaers, and defendant H. Beck Inc. (“Beck”) misappropriated for their personal use nearly $2.5 million in funds which he deposited in a brokerage account.
