The motion by the city of Bakersfield to recover attorney fees under Code Civ.Proc.§1021.5 is granted in part.
Respondent Kern Delta Water District shall compensate the city for attorney fees and costs in the sum of $106,584.50.
In reaching this calculation, the court multiplied Mr. Pearce's 247.2 hours times a reasonable billing rate of $360 per hour, for a fee of $88,992; Ms. Ansley's 49 hours times a reasonable billing rate of $330 per hour, for a fee of $16,170; and Mr. Foote's 5.9 hours times a reasonable billing rate of $275 per hour, for a fee of $1622.50.
The court could not locate Mr. Piate on either the California State Bar website or in the Duane Morris directory, and therefore does not include his "attorney" billings in the recovery.
Interest to accrue at the legal rate from and after April 17, 2015.
