Grant debtor Sharifi Amir's claim of exemption
1. The debtor has submitted a copy of his checking account statement and it has only $47.82 in it. He sufficiently demonstrates that that remaining $ 47.82 in the subject Chase checking account, ending in 2563, can be traced back to his paid earnings pursuant to C.C.P.§ 704.070. (Mr. Amir's Supplemental Declaration filed January 5, 2012; Exh. 4 [account statement from December 8, 2011 to January 3, 2012].)
2. As a result, Mr. Amir is entitled to 75% of that remaining balance, or $35.87; and the creditor FIA Card Services, N.A., is entitled to 25% of those funds, or $11.95. (C.C.P. §704.070(b).)
3. The clerk is requested to prepare an order for the court's signature.
