Grant Plaintiff City of Simi Valley's Motion for Summary Adjudication against defendant U.S. Bank National Association as Trustee ("U.S. Bank") for WFMBS 2006-AR2, on the City's second cause of action for declaratory relief in its First Amended Complaint
1. This action involves the real property located at 1668 Sweetleaf Lane, Simi Valley, a condominium as to which the City of Simi Valley had recorded a resale restriction agreement and declaration of restrictions ( attached to the recorded grant deed.) The City of Simi Valley had recorded this "declaration of conditions and restrictions on the transfer of title" as to this property in 1998, to protect the affordable housing covenants imposed by the City. On 9/9/98, a grant deed was recorded whereby the developer, Veranda Village LLC conveyed the property to defendant Eva Kostos. On 7/2/02, defendant Kustos transferred ownership of the property to defendant Regina Carchi. Ms. Carchi then took out a loan on the property w
