Plaintiff No Man Is An Island, LLC ("Plaintiff")'s application for a right to attach order and an order for issuance of writ of attachment as to Defendant Diverse Culinary Ventures, LLC ("Defendant") is granted.
Defendant's evidentiary objections are overruled. Plaintiff's request for judicial notice is denied. California Code of Civil Procedure ("CCP") § 484.090 requires that the court issue a right to attach order if it finds all of the following: (1) the claim upon which the attachment is based is one upon which an attachment may be issued; (2) the plaintiff has established the probable validity of the claim upon which the attachment is based; (3) the attachment is not sought for a purpose other than the recovery on the claim upon which the attachment is based; and (4) the amount to be secured by the attachment is greater than zero. See Cal. Code Civ. P. § 484.090(a). Defendant does not dispute that Plaintiff satisfies CCP § 484.090(a)(2) and (a)(4).
