The complaint is dismissed without prejudice as to Plaintiff Pedro Barrera for failure to substitute a personal representative. San Diego Superior Court Rules, Rule 2.5.3.
The complaint is dismissed without prejudice as to Plaintiff Carlos Barrera for disobedience of the court's order of 7/23/21. CCP § 2030.290(c) and 2031.300(c).
The Court notes that as ordered on 6/16/21, Attorney Justin Hewgill remains the attorney of record for Plaintiffs until a proof of service of the 6/16/21 signed order is filed with the court. CRC § 3.1362(e). To date, this has not occurred.
Defendant shall submit a proposed judgment of dismissal by 9/20/21.
