1. Overview and Procedural Posture.
This is a contract and fraud action arising out of the litigation of and purported settlement of earlier small claims litigation in the North County branch of this Court, which in turn arose out of contracting work in connection with a remodeling/construction project in Encinitas. The eight-count complaint was filed February 13, 2019. Among other things, plaintiff accuses defendant of using an "impostor" in connection with a court-sponsored mediation.
Defendant demurred to, and sought to strike portions of, the complaint. ROA 11-20. The demurrer attacked all counts on various grounds, and the motion to strike attacked numerous paragraphs thereof. On June 21, 2019, after full briefing, the court sustained the demurrer with leave to amend. ROA 28. The eight-count FAC was then filed. ROA 29. Defendant answered and cross-complained. ROA 39-42
