Plaintiff's unopposed OSC Re: Preliminary Injunction is taken off calendar for defective service. On Nov. 4, 2016 Plaintiff filed documents showing he served Defendants with "documents supporting the Temporary Restraining Order..." issued on Aug. 18, 2016 by fax on Defendant TD Services and by e-mail on Defendant Federal National Mortgage Assoc., and Seterus, Inc.

The papers filed on Nov. 4, 2016 do not show valid service for the following reasons: 1. The proofs of service are not in proper form as they failed to adequately describe the papers served; 2. assuming the papers served include the summons and complaint, service by fax and/or email does not comply with the requirements in CCP 413.10 et seq; 3. service of the TRO by fax and/or email is not sufficient to show the party to be enjoined has personal notice of it; 4. Email service is not valid absent an agreement for such service pursuant to Calif. Rule of Court 2.251(b); and 5. Service by fax is invalid absent a written confirma
