Objections 1 and 2 to the Benjamin Williams declaration are sustained. The balance of Defendants' evidentiary objections to the Benjamin Williams declaration are overruled.
Objection 4 to the Andre Williams declaration is sustained. The balance of Defendants' evidentiary objections to the Andrew Williams declaration are overruled.
In ruling on a motion for summary judgment, or summary adjudication, the Court is required to: (a) identify the issues framed by the pleadings; (b) determine whether the moving party has established facts justifying judgment in its favor; and (c) if the moving party has carried its initial burden, the Court must decide whether the opposing party has demonstrated the existence of a triable, material fact issue.
