DROPPED FROM CALENDAR. After reviewing the allegations of the complaint, the Court
finds that the present unlawful detainer action is not based on a failure to pay COVID-19
related rent, therefore there is no basis for a hearing under Code of Civil Procedure
section 1179.03, subdivision (h). In other words, since the unlawful detainer action is not
based at least in part on a failure to pay rent, providing the landlord or the court with a
declaration of COVID-19 related financial distress does not give rise to any relief under
the COVID-19 Tenant Relief Act or provide a valid defense to the action.
