Motion for Summary Judgment and/or Adjudication
The Court grants the Motion by Defendant PADI Americas Inc. for Summary Adjudication as to Issues 1-13 and 16-18, thus completely resolving the First, Second, Third, Fourth, Fifth, Sixth and Eighth Causes of Action. The Court denies the Motion as to Issues 14, 15, and 19 through 22 – i.e., it denies summary adjudication of the Seventh, Eleventh, Twelfth, Thirteenth and Fourteenth Causes of Action.
The Ninth and Tenth Causes of Action were not at issue on Defendant’s motion.
The Court overrules Defendant’s objection to, and request to strike, Plaintiff Joseph Wucherpfenning’s Separate Statement of Disputed Facts. Defendant cites Batarse v. Service Employees Internat. Union, Local 1000 (2012) 209 Cal.App.4th 820, 826 for the proposition that the court should strike all of Plaintiff’s additional facts because the facts are not linked to specific issues. This case is plainly distinguishable. There, the plaintiff disputed some facts but failed
