MOTION FOR TERMINATING SANCTIONS
This is a special claim opposing forfeiture. This is a motion by the moving party for terminating sanctions based on claimant’s failure to provide “complete” responses to form and special interrogatories. The motion must be denied as premature and unsupported by the present record.
By filing a claim for return of the seized assets, claimant has voluntarily subjected himself to certain obligations, not the least of which is cooperation in the discovery process. See H&S §11488.5(c)(3); see People v. 25651 Minoa Dr. (1992) 2 Cal.App.4th 787, 791.
On 06/27/18, The moving party caused to be served by regular mail upon claimant a set of form and special interrogatories. Neither the discovery requests, nor the responses, have been included with the pending motion but it appears claimant may have neglected to answer a few of the questions posted.
