22CV395955 Sonasoft Corporation vs Plaintiff’s Motion to Enforce Settlement is DENIED. The Court carefully
Ankur Garg et al reviewed the settlement agreements and motions, and at no point did the
parties stipulate that the Court would retain jurisdiction to enforce the
settlement pursuant to Code of Civil Procedure section 664.6, much less
communicate such stipulation to the Court. Such an express stipulation is
required before the Court can enter judgment pursuant to the parties’
settlement agreement terms. (See Sayta v. Chu (2017) 17 Cal.App.5th 960,
963.) Without such stipulation communicated to the Court, Plaintiff must
proceed by way of a breach of contract claim. Court to prepare formal
order.
