PETITION FOR WRIT OF MANDATE
Based on the following discussion, Petitioner’s application for a writ of mandate is
denied.
BACKGROUND
Petitioner Anne Segal brings this action to challenge the City’s November 29, 2022
adoption of Resolution No. NS-30,075 and related approvals for the development of the
Watermark Santa Cruz Senior Housing project (the Project) by Real Party in Interest Roger
Bernstein and Intervenor Oppidan Inc. (collectively, the “Respondents”)
The Project is a 74,218 square foot, two-story senior housing facility that consists of a
total of 76 units, including 59 assisted living units, and15 memory care units. Thirteen of the
units will have full kitchens, and three of these units will be affordable housing. The Project is
located on a 3-acre parcel on Pelton Avenue, (the former site of Gateway School), adjacent to the
