Intrusion into private affairs: The Court sustained with leave to amend the second cause
of action to enjoin intrusion into private affairs so that Plaintiffs could plead facts showing an
invasion that is highly offensive. In the previous complaint, Plaintiffs merely provided
conclusory language that Defendants’ use of their new decks will dominate and intrude on
Plaintiffs’ privacy while they use their homes and yards and that such intrusion would be highly
offensive to a reasonable person. (SAC ¶¶ 45-46) The TAC alleges that a person standing on
Defendants’ first level deck would be 6-7 feet above Plaintiffs’ adjacent privacy fences, that the
