RULING ON MOTION OF DEFENDANTS SO. CAL. PIZZA CO., LLC and SOCAL PIZZA HOLDINGS LLC TO COMPEL ARBITRATION AND STAY ACTION
BACKGROUND: Action for age discrimination and wrongful term -
TIMELINE:
o/a 11/22/16: Plaintiff allegedly began working for defendants, who
allegedly do business as “Pizza Hut,” as a pizza delivery driver.
Plaintiff, who was in his late 60s when he was hired, alleges that
he was subjected to age discrimination during his employment –
e.g., coworkers and his supervisor, Randy Loza, would call him
“abuelito” [meaning “grandpa]”; also, Mr. Loza allegedly
continuously showed preference to younger deliverymen,
and assigned Plaintiff the furthest deliveries and the least favorable hours
on or about February 25, 2019: Mr. Loza allegedly started reducing Mr. Melo’s hours from 40 hours to 25, and ultimately to 2 hours per week
after 7/13/19:
