DEMURRER
The demurrer to the First cause of action for discrimination is sustained with leave to
amend. Plaintiff fails to allege that the alleged different treatment was motivated by gender.
The demurrer to the Second cause of action for harassment is sustained with leave to
amend. Plaintiff does not allege sufficient facts to constitute a cause of action for harassment
under Cal Civ Code §§ 51.9, 1940.2 or 1954, therefore the demurrer is sustained with leave to
amend.
The demurrer to the Third cause of action for Intimidation is sustained with leave to
amend as the allegations are vague, uncertain, and unintelligible.
Plaintiff’s allegations do not state sufficient facts to constitute a cause of action for
retaliation (Civil Code §1 942.5), therefore the demurrer to the Fourth cause of action is
sustained with leave to amend.
