BACKGROUND:
This action arises out of allegations that the defendants committed promissory fraud and breached guaranty agreements regarding promissory notes in the amount of $400,000.00 and $136,000.00, plus interest. (Complaint, ¶¶ 7-12, 15-21.)
On October 21, 2020, Plaintiffs EZ Investment, LLC and Pinghua Bian commenced this action against Defendants Howard Wu and Taylor Woods for (1) breach of written guaranty; (2) breach of written guaranty; and (3) promissory fraud.
On February 24, 2021, the Court overruled Defendants’ demurrer to the third cause of action for promissory fraud.
