Angela Carrillo, et al. v. U.S. Bank National Association

Case No. 20STCV32936

Defendant’s Demurrer

Plaintiffs Angela Carrillo, Jose Sepulveda, and Mitzuh Carrillo (collectively, “Plaintiffs”) filed this action against Defendant U.S. National Bank Association (“Defendant”) asserting causes of action for quiet title, wrongful foreclosure, and unfair business practices in violation of Business and Professions Code section 17200.

Plaintiffs allege that they were the owners of certain real property, and that Defendant foreclosed on the property on or about January 17, 2019.

(Complaint, ¶¶ 7-8.)

Plaintiffs allege that at the time of the foreclosure, their loan was in active loan modification review.

(Id., ¶ 9.)

Therefore, Plaintiffs allege that Defendant was not permitted to foreclose on the property.

(Ibid.)

This action was filed on August 31, 2020.
