BACKGROUND

Plaintiff Tom Yang (“Plaintiff” or “Yang”) filed his complaint on June 17, 2020 against Defendant Venice Business Partners, Inc. (“Defendant” or “VBPI”). Plaintiff alleges that in October 2018, Michael Lloyd Levine approached Plaintiff with a business proposition. (See Compl. ¶ 8.) According to the complaint, Levine represented to Yang that Levine had an opportunity to ‘flip’ an allegedly very rare vehicle (a 2018 Mercedes G650 Landaulet) (“G-Wagen”) of which only 99 vehicles were ever produced. (Id.) Levine represented to Yang that the G-Wagen could be purchased for $1.2 million and then sold within 60 days for $1.8 million, and requested that Levine partner with Yang by lending to Levine’s company VBPI.
