Procedural Background

On March 16, 2020, Plaintiff Francisco Arechiga, as an individual and on behalf of all other aggrieved employees (“Plaintiff”) filed the instant action against defendant Harbor Freight Tools USA, Inc. (“Defendant”) for a single cause of action for Civil Penalties Under the Private Attorneys General Act (“PAGA”) (Labor Code § 2698 et seq.).

On July 7, 2020, Defendant filed the instant motion to compel arbitration. On July 9, 2020, all hearing dates were vacated and transferred to the instant department. (Minute Order 7/9
