Tentative Ruling on Petitioner’s Motion for Petition for Inspection and Abatement Warrant The City of Angels Camp has Petitioned for an Inspection and Abatement Warrant for the noted residence which has been deemed a public nuisance due to extremely hazardous and unsanitary conditions, among other areas of concern.
The Declarations of Steven Flaigg and David Hanham provide sufficient evidence to grant the petition and approve the warrant. Further, the property owners received proper notice and sufficient time to correct the documented problems. However, to date, the property remains a public nuisance.
Although this matter was originally on calendar 9/7/18, the matter was continued to allow defendants to respond. After reviewing defendants’ Rebuttal to Request, the Court finds the property remains a public nuisance and the Petition for Inspection and Abatement Warrant is Granted.
