This is a post-judgment matter. The Complaint alleged a breach of contract for repairs to a commercial building. Plaintiff ABC provided roofing and related construction materials to Defendants for use on various construction projects under an oral credit agreement. Plaintiff submitted various invoices but Defendants failed to pay. The reasonable and current market value of the work was $161,379.56.

Default was entered on March 4, 2020 as to Mirabal. Default was entered as to Mac Pro Sales and Installation Inc. on April 10, 2020. Default judgment was entered against Defendants on June 30, 2020 in the amount of $167,473.49.

On March 30, 2021, Plaintiff filed an opposition to claim of exemption. No opposition was submitted.

Legal Standard

After being served with the claim of exemption and notice, a judgment creditor may oppose a claim of exemption by filing an opposition with the levying officer, or the property will be released whether or not the exemption claim is valid. (CCP § 703.
