[TENTATIVE] ORDER RE: DEFENDANT’S MOTION TO STRIKE PUNITIVE DAMAGES CLAIMS

On January 3, 2020, plaintiff Melissa Divanna (“Plaintiff”) filed her Second Amended Complaint (“SAC”) alleging that Uber driver Oscar Del Rio uploaded her private photos after she left her cell phone in the driver’s car. Defendant Uber Technologies, Inc. (“Defendant”) filed this motion to strike on February 5, 2020, seeking to strike Plaintiff’s prayer for punitive damages and the related allegations.

The court may, upon a motion or at any time in its discretion: (1) strike out any irrelevant, false, or improper matter inserted in any pleading; or (2) strike out all or any part of any pleading not drawn or filed in conformity with the laws of California, a court rule, or an order of the court. (Code Civ. Proc., § 436, subds.(a)-(b).)
