Allegations of the Complaint
Plaintiffs, Kamran Ghadimi, M.D. and Advanced Pain Treatment Medical Center filed this action against Defendant, Richard Nelson for breach of contract, common counts, and quantum meruit.
Plaintiffs allege Defendant received medical services on 4/25/13, including two steroid injections and two sessions of radio frequency nerve ablation.
Plaintiffs allege Defendant, prior to receiving such services and as a condition of receiving such services, signed a written contract agreeing to pay any amount not covered by his insurance.
Plaintiffs allege they made multiple attempts to obtain payment from Defendant’s insurance, but as of March of 2018, Plaintiffs understood Defendant’s insurance carrier would not be making any payments for the services.
On 3/26/18, Plaintiffs requested payment from Defendant directly, but did not receive any written response.
