C. Factual
This is an action for personal injuries arising out of a motor vehicle accident. According to the allegations of the complaint (“Complaint”), on August 12, 2019, Plaintiff made a complete stop for traffic while driving southbound on Highway 101 through Mountain View. (Complaint, ¶¶ 10-11.) Defendant Joseph Emmanuel Johnson (“Johnson”), driving directly behind Plaintiff in a Toyota Prius, took his attention off the road to look at his cell phone and consequently failed to stop, striking the rear of Plaintiff’s vehicle. (Id., ¶¶ 12-14.) Plaintiff suffered injuries as a result of the collision. Smith is alleged to have been the registered owner of the Toyota Prius at the time of the subject incident. (Id., ¶ 7.)

Based on the foregoing, Plaintiff filed the Complaint on October
