APPLICATION FOR ORDER FOR SALE OF DWELLING
The application for an order of sale of dwelling is denied unless plaintiff provides proof
of compliance with the notice requirements of Cal. Code Civ Proc § 704.770 prior to or at the
hearing.
If proof of notice is made to the satisfaction of the court, a hearing will be held to
determine whether or not the dwelling is exempt pursuant to Cal. Code of Civ. Pro.§ 704.780 et
seq. The court will also require plaintiff to provide an appraisal or valuation of the remainder
interest in the property at issue.
