On October 18, 2018, Plaintiff James Underwood and Defendants Ace Industrial Supply, Inc., Holden Stearns, and Timothy Stearns entered into a Mutual Release and Agreement arising from a whistleblower claim. Defendants agreed to pay Plaintiff $10,000 for the identification of certain third parties that “either illegally or improperly acquired certain” account information owned by Defendants. Defendants admittedly paid $8,300 of the $10,000, but failed to pay the remaining $1,700.
