On August 6, 2019, plaintiff Jose Rudy Ortega filed this action against defendant Robert Mathew Yellow-Owl arising from an August 10, 2017 automobile accident. Loya Casualty Insurance Company (“Intervenor”) seeks to intervene on behalf of Defendant. At the time of the accident, Defendant had an automobile insurance policy with Intervenor. However, Intervenor has not been able to contact Defendant despite multiple attempts to locate him and communicate with him. In the meantime, Plaintiff has served written discovery and made a statutory offer to compromise. Intervenor seeks to intervene in order to provide a defense for Defendant.
