Having considered the moving, opposing, and reply papers, the Court rules as follows.
BACKGROUND
On February 25, 2019, Plaintiff Kimia Davoodi (“Plaintiff”) filed a complaint against Defendants Orlando Hernandez, Genobel Villanueva, Bobby Asadi, and Mehdi Seyed Movaghar. The complaint alleges strict liability and negligence for a dog bites that occurred on January 7, 2019.
On April 11, 2019, Defendants/Cross-Complainants Bobby Asadi and Mehdi Seyed Movaghar filed a cross-complaint against Defendants/Cross-Defendants Orlando Hernandez and Genobel Villanueva seeking contribution, indemnity, and declaratory relief.
On September 17, 2019, the Court approved amendments to Plaintiff’s complaint renaming Defendant/Cross-Defendant Genobel Villanueva as Defendant/Cross-Complainant Genobel Margarita Sanchez Villanueva and Defendant/Cross-Defendant Oralndo Hernandez as Defendant/Cross-Defendant Aristides Orlando Hernand
